Service of Process Out of Town- IMPORTANT MESSAGE If you have an out of state service and the papers are filed in a Georgia court, most judges require that you get an out of state server appointed. In order to obtain an appointment, the court requires an affidavit from the server stating he is not a party to the case along with additional information and a motion and order. 1. Email MLQ (orders@mlqas.com) the ZIP code of the address where we are serving and we will obtain names on whom to appoint. DOWNLOAD HERE the affidavit that the process server must sign to be attached to the motion and order. The judge will require the original signature of the server. Please fill this out with your case information and email back to us and we will forward to the server. Please advise if you would like the affidavit returned by regular mail or sent overnight.2. DOWNLOAD HERE a sample of the motion and a sample of the order. The judge will require the attorney’s original signature on the motion. Once you have this completed and you have the original affidavits from the server(s), you can file or MLQ can file (additional fees would apply). 3. Once the order has been signed, we will proceed with service. We ask that you wait to send the service papers until the order has been signed. There is a $25 fee per location for this service.
